Vehicle Transport Posting Terms

Lads Motors LLC — Vehicle Transport Posting Terms and Conditions

PLEASE READ CAREFULLY. THESE TERMS INCLUDE A RELEASE OF LIABILITY, LIMITATIONS OF LIABILITY, AND A HOLD-HARMLESS AGREEMENT.

These Terms and Conditions apply to vehicle transportation posting requests submitted to Lads Motors LLC (“Lads Motors,” “we,” “us,” or “our”). “Customer,” “you,” and “your” mean the person or business submitting the request.

1. Scope of Service

Lads Motors provides a vehicle transportation posting service using information supplied by the customer. Submission authorizes Lads Motors to post and communicate your transportation request to third-party transportation providers.

For this posting service, Lads Motors does not take custody of, operate, load, unload, store, or transport your vehicle, and does not provide cargo insurance.

Submitting a request does not guarantee carrier availability, acceptance, transportation pricing, insurance coverage, pickup, delivery, or completion within any particular timeframe. Any additional services must be separately agreed to in writing.

2. Authority and Accuracy of Information

You represent that you own the vehicle or have the owner’s authorization to request transportation, share vehicle information, provide release credentials, and authorize pickup and delivery.

You are responsible for supplying complete and accurate information, including:

  • Vehicle identification number, year, make, and model.

  • Pickup and delivery addresses and contact information.

  • Buyer number, lot or stock number, release PIN, and gate pass.

  • Pickup and delivery hours and appointment requirements.

  • Vehicle condition, dimensions, modifications, and loading requirements.

  • Payment status, release restrictions, storage deadlines, and outstanding charges.

You must promptly report changes or errors. Lads Motors is not responsible for losses or expenses resulting from incorrect, incomplete, outdated, unauthorized, or misleading information supplied by you or another third party, except to the extent applicable law provides otherwise.

3. No Identity, Licensing, or Insurance Verification

Lads Motors does not undertake to independently verify or guarantee any third party’s identity, ownership, authorization, licensing, operating authority, insurance, qualifications, equipment, safety history, or ability to perform transportation.

Forwarding a name, telephone number, carrier document, insurance certificate, identification document, or other information does not constitute authentication, approval, endorsement, or a guarantee of validity.

Before authorizing vehicle release, you are responsible for independently confirming the carrier, driver, pickup authorization, applicable operating authority, and insurance coverage directly through appropriate sources.

4. Independent Transportation Providers

Carriers, drivers, towing companies, storage facilities, auction facilities, and other transportation participants are responsible for their own services, personnel, equipment, conduct, and legal obligations.

A third party does not become an employee or agent of Lads Motors solely because Lads Motors posts a request or forwards information.

Transportation rates, payment arrangements, bills of lading, delivery procedures, insurance obligations, and claims are governed by the applicable transportation agreement and applicable law.

5. Auction and Facility Damage — Including IAA and Copart

To the fullest extent permitted by law, Lads Motors is not liable for damage, loss, unauthorized release, missing items, delays, or charges caused by IAA, Copart, Manheim, another auction, a seller, a storage yard, a dealership, a towing company, a carrier, a driver, or their respective employees, contractors, or representatives.

This includes damage or loss occurring during storage, retrieval, movement within a facility, loading, unloading, towing, winching, forklift handling, transport, or delivery.

It also includes damage caused by a third party’s negligence, improper handling, unsafe driving, inadequate securement, incorrect equipment, failure to inspect, failure to follow instructions, or release of the wrong vehicle.

This provision limits claims against Lads Motors to the extent lawful. It does not release any auction, carrier, driver, or other responsible party from its own obligations or liability.

6. Transportation and Handling Risks

You acknowledge that vehicle transportation and handling involve risks, particularly for salvage, damaged, modified, non-running, flood-damaged, or otherwise compromised vehicles.

Subject to the limitations and exceptions in these terms, Lads Motors is not responsible for third-party losses involving:

  • Collisions, crashes, rollovers, overturns, jackknifes, or vehicles falling from transport equipment.

  • Improper loading, unloading, towing, winching, lifting, or forklift handling.

  • Broken straps, chains, tie-downs, ramps, trailers, lifts, or securement equipment.

  • Fire, smoke, explosion, electrical failure, fuel leaks, or battery-related incidents, including electric-vehicle battery fires.

  • Theft, attempted theft, hijacking, conversion, disappearance, vandalism, or unauthorized use.

  • Fraud, impersonation, identity theft, forged documents, fraudulent pickup instructions, or unauthorized release.

  • Flooding, rain, snow, ice, hail, wind, lightning, falling objects, road debris, or other weather and environmental events.

  • Scratches, dents, broken glass, body damage, paint damage, frame damage, undercarriage damage, or interior damage.

  • Damage to engines, transmissions, suspension, brakes, steering, tires, wheels, electrical systems, batteries, or other components.

  • Fluid loss, dead batteries, mechanical breakdown, or worsening of preexisting damage.

  • Missing keys, documents, plates, accessories, detachable parts, tools, or personal belongings.

  • Bodily injury, death, or damage to other property caused by third parties.

Listing a risk does not mean that insurance covers it or that every resulting claim can lawfully be waived.

7. Salvage, Inoperable, and Unsafe Vehicles

You must disclose conditions that could affect safe pickup, handling, or transportation, including whether the vehicle runs, rolls, steers, and brakes; whether keys are available; and whether the vehicle has loose parts, fluid leaks, fire damage, flood damage, unstable components, or a damaged battery.

You must disclose oversized dimensions, lowered suspension, modifications, missing wheels, locked wheels, and any need for specialized equipment.

A submitted request does not certify that a vehicle is safe to move. The transportation provider remains responsible for its handling decisions and applicable safety duties.

8. Release Credentials, Fraud, and Identity Theft

Buyer numbers, release PINs, gate passes, and similar credentials may permit access to or release of a vehicle. You authorize their disclosure only as reasonably necessary to communicate and fulfill your authorized transportation request.

Do not submit account passwords, Social Security numbers, banking credentials, or unrelated sensitive information.

You are responsible for independently confirming unexpected changes to carrier identity, pickup instructions, payment instructions, or delivery destination through a previously verified contact.

To the fullest extent permitted by law, Lads Motors is not liable for fraud, identity theft, impersonation, unauthorized account access, or misuse of release credentials caused by third parties. Nothing in these terms excuses Lads Motors from privacy, security, notification, or other obligations imposed by applicable law.

9. Insurance and Claims

Lads Motors does not provide vehicle, cargo, theft, fire, liability, or personal-property insurance through this posting service.

You are responsible for determining whether appropriate coverage exists and whether it covers the vehicle, its condition, its value, the transportation method, and the relevant risks. Insurance documents do not guarantee that coverage is active, sufficient, or applicable to a particular loss.

Claims should be promptly reported to the responsible party and relevant insurer. Applicable contracts and laws may impose notice requirements and filing deadlines.

Nothing in these terms reduces a carrier’s legal obligations or waives rights that applicable law makes nonwaivable.

10. Vehicle Condition and Delivery Documentation

Arrange for photographs and condition documentation before pickup and at delivery whenever possible. Review the bill of lading or condition report and record visible damage, missing items, or discrepancies before signing.

Report concealed damage promptly after discovery. Your signature, inspection, or failure to note damage has only the legal effect permitted by the applicable transportation agreement and law.

Lads Motors does not independently inspect or certify vehicle condition through this posting service.

11. Personal Property and Loose Items

Remove personal belongings, valuables, cash, identification documents, toll transponders, and unsecured items before pickup whenever possible. Disclose any loose parts or other items that must accompany the vehicle and obtain the carrier’s agreement to transport them.

Lads Motors does not inventory, safeguard, or insure items left in or with the vehicle and is not responsible for their loss or damage caused by third parties, subject to applicable law.

12. Scheduling, Charges, and Delays

Pickup and delivery dates are estimates unless expressly guaranteed by the responsible provider in writing.

Delays may result from weather, traffic, equipment failure, facility restrictions, vehicle condition, missing documents, unpaid charges, driver availability, or other circumstances.

Unless otherwise agreed in writing, you are responsible for applicable carrier charges, auction charges, storage, gate fees, loading fees, towing, redelivery, failed pickup, and other charges arising from your transportation arrangements. This provision does not authorize undisclosed charges or excuse charges caused by conduct for which Lads Motors is legally responsible.

Changes or cancellation requests must be communicated promptly. Cancellation of a posting does not automatically cancel a separate carrier agreement or eliminate charges lawfully owed under that agreement.

13. Release and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE LADS MOTORS LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS FROM CLAIMS ARISING FROM THIRD-PARTY ACTS OR OMISSIONS IN CONNECTION WITH YOUR VEHICLE TRANSPORTATION REQUEST.

This includes claims arising from the third-party events described above, including auction damage, driver negligence, theft, fraud, identity theft, fire, collision, rollover, unauthorized release, vehicle damage, missing property, delays, and related expenses.

TO THE EXTENT LAWFULLY ENFORCEABLE, THIS RELEASE ALSO INCLUDES CLAIMS BASED ON LADS MOTORS’ OWN ORDINARY NEGLIGENCE IN PERFORMING ITS POSTING AND COMMUNICATION SERVICES.

To the fullest extent permitted by law, Lads Motors will not be liable for consequential, incidental, special, exemplary, or punitive damages arising from this posting service, including lost profits, lost rental income, lost business opportunities, loss of use, diminished value, or substitute transportation expenses.

These limitations do not apply to Lads Motors’ gross negligence, willful or wanton misconduct, intentional wrongdoing, fraud, or any liability or remedy that applicable law prohibits limiting or excluding.

14. Indemnification and Hold Harmless

To the fullest extent permitted by law, you agree to indemnify and hold harmless Lads Motors LLC and its owners, officers, employees, and agents against third-party claims, damages, liabilities, and reasonable legal expenses to the extent caused by:

  • Your lack of ownership or authorization.

  • Inaccurate, incomplete, or misleading information you provide.

  • Your unauthorized disclosure or use of release credentials or personal information.

  • Your failure to disclose known vehicle conditions or hazards.

  • Your breach of these terms.

  • Your negligence or unlawful conduct.

This obligation does not require you to indemnify Lads Motors for its own negligence, gross negligence, willful misconduct, fraud, or any liability that cannot lawfully be shifted to you.

15. Permission to Use and Share Submitted Information

You authorize Lads Motors to use and disclose submitted contact information, vehicle details, pickup and delivery information, and necessary release documents for posting and communicating your transportation request.

You represent that you have permission to provide information about other contacts listed in the request. This authorization does not permit unrelated use or sale of sensitive release credentials and remains subject to applicable privacy law.

16. Governing Law and Nonwaivable Rights

These terms are governed by Michigan law, except where applicable federal law controls.

Nothing in these terms overrides mandatory transportation laws, consumer protections, privacy obligations, insurance requirements, or other nonwaivable rights or duties.

If a provision is found unenforceable, it will be limited or severed as permitted by law, and the remaining provisions will continue to apply.

17. Entire Agreement and Acceptance

These terms govern the posting service together with any separate written service agreement accepted by you and Lads Motors. They do not replace a carrier’s transportation agreement.

Changes to these terms apply prospectively and do not retroactively alter an accepted request without agreement.

By checking the boxes below and submitting your request, you confirm that you have read and understood these terms and are authorized to accept them.
